Convention of States? What is That?

45

45 per session - Virtual OK - Posted Oct 22, 2017

You've probably heard about the "convention of states" movement to amend the U.S. Constitution advocated by everyone from Mark Levin to Lawrence Lessig. But do you know what it is all about? Is it a "constitutional convention?" Will it run amuck? What sorts of amendments can be proposed? How does it work? In this 30 minute consult, I'll give you an overview of the constitutional law and theory behind the power to propose amendments to the U.S. Constitution by convention, the status of the movement, the various groups involved in advocating for it, and the arguments for and against both the various types of approaches to achieving a "convention of states" and the entire idea of holding a convention to propose amendments to the constitution. If you want some free resources, there are a bunch of educational videos here: www.youtube.com/compactforamerica

Training & Qualifications

I've researched, published and lectured in the field of constitutional law dealing with the "convention of states" process for nearly 10 years. I also lead one of the top three efforts advocating for proposing amendments by convention known as "Compact for America." I have an insider's perspective of the movement and a deep understanding of the law and theory behind it.

About Nick Dranias

CAVEAT to offered services: I am only licensed to practice law in Arizona, Illinois, Minnesota, Texas and Washington, DC, and I generally operate out of Arizona. If you do not reside in one of those l...ocations and if your business is not based in one of those locations, I will only be able to represent you if your legal issue has some substantial connection to one of my licensed locations (such as someone you want to sue/negotiate with being located there, you desiring to establish a business presence there, or your issue somehow being governed by the law there) OR if your legal issue strictly involves federal law (such as intellectual property, taxes, tariffs, federal court litigation, constitutional law). If I can't represent you, and you live or have a business in Florida, I would recommend Susannah Savitsky, who offers legal services under Florida licensure on simbi. Otherwise, I have colleagues who are not on simbi who are licensed in California, New Mexico and North Carolina, so I can refer you to them if you reside or do business there. I also know of other reputable attorneys, not on simbi, licensed in other states. Nicholas "Nick" C. Dranias is sole managing member of Nick Dranias Law & Policy Analysis LLC. Over a legal career spanning two decades, he has litigated well over one hundred cases and handled hundreds of transactional matters spanning business, real estate, contracting, private lending, non-profit and estate law. When litigating, he does not hesitate to develop creative and effective tactics for securing a remedy, including injunctive relief, mandamus and temporary restraining orders, as well as seeking emergency appellate review where possible. Previously, Dranias served as General Counsel, Policy Development Director and Constitutional Policy Director at the Goldwater Institute. Dranias led the Institute’s successful challenge to Arizona’s system of government campaign financing to the U.S. Supreme Court. Prior to that, Nick was an attorney with the Institute for Justice for three years and an attorney in private practice in Chicago for eight years, where he served as Young Lawyers Section co-editor of the Chicago Bar Association Record, authored numerous articles, and earned the Oliver Wendell Holmes Award for his service. At the Loyola University Chicago School of Law, where he earned his JD, Nick served on the Loyola University Chicago Law Review, competed on Loyola’s National Labor Law Moot Court Team, and received academic awards for the top grade in his land use law, remedies and legal writing classes. He graduated cum laude from Boston University with a B.A. in Economics and Philosophy. Dranias has written and published over one hundred articles in law and public policy, including law review articles, public policy reports, and opinion editorials. He currently serves as the President of Compact for America Educational Foundation. Nick also serves as Policy Advisor and Research Fellow with the Heartland Institute, and as an expert and Speaker's Bureau member with the Federalist Society, a Law and Civil Liberties Speaker for Students for Liberty, as well as an Advisory Council member for Our America Initiative. He has appeared as an expert in constitutional law and policy on Fox News, MSN-NBC, NPR, and many other local and regional media outlets. Practicing under authority of licensure in Arizona, Illinois, Minnesota, Texas and Washington, DC, admission to U.S. Supreme Court, U.S. Courts of Appeals (7th, 8th, 9th Circuits), U.S. District Courts (AZ, EDWI, MN, NDIL), California Rules of Court, Rule 9.48(c), Delaware Lawyer's Rules of Professional Conduct, Rule 5.5(c)(4), and Wyoming Rules of Professional Conduct, Rule 5.5(c) and (d).
